Aborto in Sicilia: no ai concorsi solo per non obiettori

Il governo Meloni ha impugnato la legge siciliana 23 per assumere medici non obiettori e garantire il diritto all’aborto.

Il governo nazionale ha impugnato la legge 23 dello scorso 5 giugno, sponsorizzata dal Partito Democratico con primo firmatario il deputato Dario Safina, approvata dall’Assemblea Regionale Siciliana, che consente alle Aziende sanitarie di assumere medici non obiettori di coscienza per potenziare i reparti di Ginecologia e assicurare il diritto ad abortire sancito dalla legge 194 del 1978, che tutela il diritto delle donne all’interruzione volontaria di gravidanza. La stessa legge prevede inoltre la sostituzione dei medici non obiettori che poi, dopo l’assunzione, dovessero opporre l’obiezione di coscienza. Secondo stime non ufficiali almeno l’85% dei ginecologi negli ospedali siciliani si dichiara obiettore di coscienza impedendo alle donne di abortire. Il governo Meloni motiva in sintesi così l’impugnativa della legge 23 innanzi alla Corte Costituzionale: “Non si può negare agli obiettori di coscienza di partecipare ai concorsi. La legge violerebbe l’articolo 117 della Costituzione, che garantisce i principi di uguaglianza, di diritto di obiezione di coscienza, di parità di accesso agli uffici pubblici e in tema di pubblico concorso.” Il deputato Safina annuncia battaglia e commenta lo stop alla legge 23: “Lo Stato ha deciso di impugnare una norma di civiltà. E’ una legge che non limita nessuno, ma garantisce ciò che già dovrebbe essere garantito per legge: il diritto delle donne a scegliere, nei tempi e nei modi previsti dalla legge 194. Non un privilegio, ma un diritto. Non arretreremo di un passo. La legge non penalizza né discrimina i medici obiettori ma mira semplicemente a garantire un servizio essenziale.”
