Provincia Agrigento, Amorosia ricorre contro la nomina di La Spina

Il Libero Consorzio Comunale di Agrigento ha recentemente proceduto alla nomina della Dott.ssa La Spina quale nuovo Segretario generale dell’Ente. Si tratta di una figura di vertice a cui sono affidati rilevanti compiti di direzione e coordinamento dell’apparato amministrativo.
La nomina è stata disposta dal nuovo Presidente dell’ex Provincia regionale di Agrigento, Giuseppe Pendolino (sindaco di Aragona) che, nell’esercizio delle proprie prerogative istituzionali, ha deciso di non confermare il precedente segretario dott. Amorosia, conferendo, appunto l’incarico alla dott.ssa La Spina.
A seguito di tale nomina, il precedente Segretario – il dott. Amorosia – ha proposto ricorso giurisdizionale d’urgenza ai sensi dell’art. 700 c.p.c., dinanzi al Giudice del Lavoro del Tribunale di Agrigento, contestando presunte irregolarità nella procedura adottata per il conferimento dell’incarico.
Nel ricorso, il Dott. Amorosia ha espressamente richiesto la disapplicazione dell’intero complesso di atti amministrativi che hanno condotto alla nomina della nuova Segretaria generale, con l’obiettivo di ottenerne la sospensione degli effetti e il ripristino della situazione precedente.
In ragione della natura cautelare del ricorso e della possibile incidenza immediata sugli equilibri organizzativi dell’Ente, il Libero Consorzio Comunale di Agrigento ha deliberato di costituirsi in giudizio, affidando la propria difesa all’Avv. Girolamo Rubino, esperto in diritto amministrativo.
L’udienza relativa al procedimento cautelare è stata fissata per il prossimo 9 settembre 2025, presso il Tribunale del Lavoro di Agrigento.
La scelta di costituirsi in giudizio, con il patrocinio dell’Avv. Rubino, risponde evidentemente alla volontà dell’Ente di difendere con tempestività ed efficacia la legittimità della propria azione amministrativa, confidando che il giudizio possa riconoscere la validità degli atti impugnati e garantire la continuità dell’azione amministrativa, a beneficio della collettività e della stabilità istituzionale.
