Liquidazione prestazioni extra budget: il Tar bacchetta l’Asp di Palermo

Alcuni laboratori di analisi accreditati e convenzionati – nel 2020 – hanno erogato prestazioni in
eccesso rispetto al budget assegnato (c.d. prestazioni extra budget).
Pertanto, le suddette strutture, al fine di vedere riconosciuto il pagamento delle prestazioni rese in
eccedenza rispetto al budget, con apposito atto, hanno invitato l’ASP di Palermo a individuare le
economie di spesa e a procedere alla ricognizione delle risorse residue dell’aggregato provinciale,
nonchè alla loro assegnazione.
Tuttavia, la suddetta istanza non è stata riscontrata dall’Azienda Sanitaria e, conseguentemente, i
titolari dei sopracitati laboratori, con il patrocinio degli Avv.ti Girolamo Rubino e Giuseppe
Impiduglia, hanno proposto un ricorso innanzi al TAR – Palermo.
Con il ricorso, i predetti difensori hanno rilevato che l’Assessorato Regionale alla Salute – a mezzo
di apposito Decreto – aveva previsto l’assegnazione di eventuali risorse residue alle strutture che
nell’anno 2020 avevano erogato maggiori prestazioni rispetto al budget assegnato.
Sempre con il ricorso, è stato dedotto, come illegittimamente l’ASP di Palermo sia rimasta inerte,
essendo di contro obbligata ad accertare e quantificare l’ammontare delle economie prodotte,
assegnandole alle varie strutture che avevano erogato prestazioni in eccesso rispetto al budget,
previa stipulazione di appositi accordi integrativi.
Con sentenza del 09.07.2025, in accoglimento delle tesi degli Avv.ti Rubino e Impiduglia, il TAR –
Palermo, ha ordinato all’Asp di Palermo di definire il procedimento avviato su istanza dei suddetti
laboratori entro il termine di 90 giorni ed al contempo, nell’ipotesi di inottemperanza nel sopra
indicato termine, ha nominato Commissario ad acta il Dirigente Generale del Dipartimento per la
pianificazione strategica dell’Assessorato della Salute della Regione Siciliana.
Il TAR ha anche condannato l’ASP di Palermo al pagamento delle spese legali liquidate in euro
1.500.
Per l’effetto di tale pronuncia, l’ASP dovrà definire il procedimento amministrativo volto
all’assegnazione delle prestazioni rese in extra budget nell’annualità 2020 e pagare ai ricorrenti le
spese legali.
