Asp Agrigento, escluso da procedura di stabilizzazione: il Tar lo riammette

Nel 2023, l’Asp di Agrigento avviava una procedura di stabilizzazione ai sensi del c.d. decreto Madia per la copertura di n. 3 posti di Programmatore (Assistente Informatico).

L’Ing. A.A.T., originario di Agrigento, essendo in possesso dei requisiti richiesti, presentava la propria domanda, ma tuttavia all’esito della procedura, figurava nell’elenco dei soggetti esclusi sulla base dell’asserito presupposto che le attività prestate nell’ambito di differenti tipologie di rapporto di lavoro (lavoro a tempo determinato e collaborazioni coordinate e continuative), come quelle maturate dall’Ing. A.A.T., avrebbero dovuto considerarsi non cumulabili ai fini della stabilizzazione in questione.

Ritenendo illegittima la propria esclusione dalla procedura di stabilizzazione, l’Ing. A.A. T., con il patrocinio degli Avv.ti Girolamo Rubino e Giuseppe Impiduglia, proponeva un ricorso giurisdizionale innanzi al TAR–Palermo.

I detti legali rilevano in giudizio che secondo consolidata giurisprudenza la stabilizzazione di cui alla legge Madia non è limitata a contratti di lavoro a tempo determinato, ma è estesa a tutte le figure di contratti di lavoro flessibile; inoltre, in nessun caso la Legge Madia vieta il cumulo del contratto di lavoro a tempo determinato con altre prestazioni lavorative rese in forza di altri contratti riconducibili nella tipologia di lavoro flessibile. 

Ebbene, con sentenza del 07.03.2025, condividendo le argomentazioni difensive sostenute dagli Avv.ti Rubino e Impiduglia, il TAR-Palermo, ha ritenuto illegittima l’esclusione disposta dall’Asp di Agrigento e, pertanto, ha accolto il ricorso proposto dall’Ing. A.A.T. annullando gli atti impugnati e condannando altresì l’Amministrazione soccombente al pagamento delle spese di lite. 

Pertanto, l’Asp di Agrigento, alla luce della suddetta statuizione dovrà ammettere alla procedura di stabilizzazione l’Ing. A.A.T, riservandogli uno dei tre posti di programmatore informatico previsti.
